Nuvio Files Request for Stay of FCC VoIP - E911 Order24 October 2005
Nuvio Corporation, a leading provider of Voice over Internet Protocol (VoIP) services, today announced that it has filed with the Federal Communications Commission (FCC) a motion for a stay of the E911 Order for VoIP Service Providers. Because of the looming November 28, 2005, deadline, Nuvio has requested the FCC to stay a portion of its order until a nationwide solution is available to service providers. Previously, Nuvio had filed an appeal of this order with the U.S. Court of Appeals for the District of Columbia. "While we share the Commission's concern about deploying 911 service, and we have worked diligently to provide our users with 911 access, the 120-day requirement imposed by the FCC is arbitrary and capricious and without support in the record," commented Jason Talley, president and CEO of Nuvio. "No service provider is going to be able to provide a nationwide solution for nomadic VoIP users, and this order is inconsistent with the Commission's past decisions regarding implementation of E911 capabilities by other service providers, such as wireless."
"Over the past several months, we and others have requested direction from the FCC regarding the November 28th deadline and what we should do with users that fall outside of the E911 services we will offer, but they have either been unwilling or unable to tell us how to accommodate those users. We view November 14th as a red-letter date on this matter, and if the FCC is unprepared to deal with the reality of the marketplace, we will be forced to ask the United States Court of Appeals for the District of Columbia Circuit to do such," Talley stated.
